sir/Madam

one X is the owner of passenger carrying bus and he died due to heart attack after some days leaving behind him his wife, who use to take care of the transport business of her late husband and subsequently executed the insurance policy for the bus after the expiry of the policy of the said bus. During existence of insurance policy the vehicle mate an accident and deceased of a passenger of the bus claimed compensation from the owner as well as its it's insurance. My question is - whether the insurance liable to indemnify the said wife of "X". if yes under what provision of law ?

IF THE BUS WAS TRANSFERRED IN THE NAME OF WIDOW AND AFTER THAT INSURANCE WAS RENEWED OR IF THE INSURANCE WAS SOLD WITHOUT ANY SUPPRESSION OF FACTS ON THE PART OF WIDOW,THE INSURANCE IS BINDING UPON THE INSURER COMPANY.

I too agree with the expert advise of Sh. Prabhakar Singh. The insurance company is liable to compensate the claimants of deceased even if the ownership is still with "X" i.e., the deceased husband. The policy is in vogue and operative qua the bus.
T. Kalaiselvan, Advocate (Expert) 01 February 2015
The policy if in force as on date of accident and has been properly transferred in the name of wife, then insurance claim can be made.
