Live in relationship between married man and women

Hi experts,

I am from Gujarat, I am married man and in a relationship with a married women since few years and we both are happy, now we want to do maitri karar, is maitri karar is legal between married man and married women? If yes, what is the procedure to do so?

Live-in-relationship is fine, but that can create a ground of divorce for your wife as per law.

What will be future relations with children and relatives ?

What is Temporary and what is permanent ?

What happens if your wife also thinks in the same manner ?

Think of all this, before continuing extra marital affairs ?

Sexual relationship between a man with married woman of another man is criminal offence of adultery punishable under section 497 IPC so how that can be legal act by any means. The live in relationship between unmarried man and unmarried woman can be considered lawful to certain extend.

The Mirti Karar or friendship agreement you talk has to mention in clear term as to s*xual relationship between both of you, if you both are not indulging in s*xual relationship, than nothing wrong in such friendship but otherwise it is unlawful act, on the basis of which not only the marriages of both can get dissolved by the Family Court on the ground of adultery but even you can face criminal prosecution under section 497 IPC.

You are having illegal relation called adultry being married man and women which is punishable under IPC. Even if you execute Friendship Agreement your relationship will be called as adultry.

Maitri Karar is a practice prevalent in Gujarat. The difference between maitri karar and live-in relationship is that the former has a written agreement, whereas the latter has no written agreement. Livein relationships have come up before Supreme Court, which has approved it. Probably no maitri karar case has come before the Supreme Court.

Agreed, maitri karar is not law but a practice in Gujarat with a written contract.

Even if this practice of entering in a contract of friendship between married man and woman exists in Gujarat it's considered lawful there but if it's contrary to public policy or legal statue it will be considered null and void under section 23 of the Contract Act. Married man indulging in physical relationship with married woman of another man is against the provision u/s 497 IPC and cannot call this contract valid at all, even though it is in practice in Gujarat. Prostitute is unlawful practice and punishable offence but is being in practice since time immemorial that doesn't give it legal sanction and make it lawful practice.

I shall be highly enlightened to know the name of the Act/Rule if such law really exists which is considered valid despite existance of IPC and Contract Act.

I have corrected later. It was not law. It was a practice. It was, and probably it is still a practice in Gujarat mostly between an unmarried man and an unmarried woman. Some married men and married women, not married to each other also may be entering into such relationships. The question of validity under law would arise only when it is challenged or when there is a dispute and one of the parties goes to court.
