Right of Legal Heirs in Share of Property

we are living in a Property (Flat), which is jointly divided between my three People. i.e. 2 uncles and my father. My father died last year. My father did not made any nomination. Society has Share Certificate on which 3 Names are there. we are living in this property since 28 years. I am single child. Now my uncles denying to agree to give my father's share on my mother's name. What can be done in this matter. (earlier this property was on the name of my grandmother. She made it in writing after her death property will be divided between 3 brothers equally)

U issue legal notices to your uncles .if they deny or refuse go to civil court u &Ur mother both r joint become joint owners

Thank you so much. Can you tell me how much cost i have to manage for these legal proceedings? Bcoz I am the only earning member of my family. And one Uncle agrees but another is saying, "You will not get anything without my NOC. Now all share will be transferred to remaining 2 uncles. Your mother does not have any right into it."

To issue legal notice it may cost rs500to1000..if they come to compromise it ends.if they refuse u have to approach court forpartition.in Karnataka for partition court fee ismaximum200rs&plaint charges advocates fee as u appoint .it cost 6000to,10000 rs. But I don't no about other states than karnataka.u may contact Ur state local lawyer.

One more thing adding.. Our Society is going for redevelopment. They will start their work in next 3 months. Society says, "Make a Succession Certificate or else the project will go on delay because of you & you will have to pay the cost of it.

U give them a indemnity gaAurantee bond which binds u if any legal problem arises to Ur society.if it delays to obtain succession certificate.
