Section 43 of NDDB Act (37 of 1987) has been misinterpreted by NDDB, after Dr Kurien left NDDB in 1998, to create companies dealing with milk and milk products for commercial purposes, as against 'development' purposes which was paramount in consideration for creation of NDDB as an institution of national importance. If it was for selling milk, obviously, NDDB would not have been bestowed with a tag of 'national importance'. Its preamble and more so section 16 (1) (b) refers to the emphasis on 'cooperative strategy' for dairy development -- not the corporate route. The Ministry of Law had given its view on more or less same lines which forced NDDB to close down/merge some of the grand daughter companies it had created under the MDFVL. Even the MDFVL strictly speaking is a violation of the spirit of NDDB Act. It needs to be investigated and corrective steps taken in the interest of millions of small and marginal cooperative dairy farmers who do not get any significant help from NDDB due to its vested interest in its own dairy business (rather than developmental work).

Clearly the act is outdated and the non existent penalty of two hundred rupees can be no deterrent in this case. Instead, rigorous punishment and heavy penalties should be laid down.

advocacy is generated for social well being, when so is it the responsibility of the society to protect the integrity of the profession still lurking in such advocates who for one reason or other had to give up practice.

i do think for normal person as advocate on cessation of practice might be given some 2 persons ..husband and wife..to lead a simple life, for that what there can be a simple advocates welfare cooperative society ltd could be conceived, so that they need not be a disgrace to the society for they are misused by forces which want to attack good society by all kinds of means promotion 'actus reas' and 'mens rea' ..for such endeavour even governments could make some social fund allocation, besides some philanthropists might donate, is my view!

Law making is supposed to reduce all kinds of corruption but law making in india simply increases all varieties of corruption when so judiciary in india should be completely away from executive and legislature is my considered thought.

better not make too many unnecessary amendments at the drop of a hat is my advice to all law makers please, true you as a class being egotistic it is indeed doubtful, as you as a class think you are the end of the world, but such attitude you nurture is indeed counter productive.
