Syllabus for Bar Council qualifying examination for Indian Nationals holding foreign Law Degrees

The examination will consist of six papers covering certain aspects of substantive and procedural laws essential for every legal practitioner licensed to practice in India. The standard of examination will be that of the law courses in Universities recognised by the Bar Council of India.

Each paper will be of three hours duration consisting of five of six questions to be answered in English. For procedural subjects, consultation of bare acts in answering questions is permissible. Questions will be both descriptive theory based as well as problem type short answer ones.


            The tentative syllabi of the six papers are as given below :-

PART - I : SUBSTANTIVE LAW PAPERS

Paper I : Indian Legal System and the Constitution of India

The Legal System will comprise of the legal and constitutional history of India during the British period and the making of the Indian Constitution.

            The module on Constitution of India will include the structure of Government, the basic features of the Constitution, the bill of rights. Centre - State relations, the union judiciary including central tribunals and the system of democratic decentralisation.

Paper II : Family ( Personal Laws of India )

            This paper will include the law relating to marriage, separation, divorce, maintenance, custody of children, adoption, inheritance and succession, which are spread in both customary law and statutory law. Apart from Secular Statutes like Special Marriage Act and the law of maintenance under Criminal Procedure Code, the paper will expect the examinees to be familiar with the religion based personal laws on all the above topics of Hindus and Muslims, the major religious groups in India.

Paper III. Environmental and Consumer Laws

            This paper is intended to test the familiarity of the candidate with the Indian environmental law regime evolved mostly through statutes enacted in the last 25 years and cases decided by the Courts in the recent past.

            Similarly, the candidates are expected to be familiar with the consumer Protection Act and its provisions which are increasingly becoming a major part of litigation in India

PART II : PROCEDURAL LAWS

Paper IV : Criminal Procedure Code and Criminal Evidence

            Basic understanding of the structure of criminal courts and the various stages of a criminal proceeding is what is expected in this paper. Similarly, the law of evidence as contained in the Indian Evidence Act and as applicable to criminal proceeding will be examined in this paper.

Paper V : Civil Procedure Code and Transfer of Property Act.

            In the field of civil litigation, the controlling statute is the Civil Procedure Code and the relevant provisions of the Evidence Act. The hierarchy of courts and their jurisdiction as well as the procedure for conduct of trials are spelt out in the Sections and orders of the Code.

            A related matter on which basic knowledge is essential for every practicing lawyer late to the transfer of immovable property for which the law is laid down in the Transfer of Property Act.

Paper VI : The Indian Legal Prodfession and Code of Ethics

            The sixth paper in the Bar Council examination relates to the structure, conduct and management of the Legal profession. Basically, it expects an understanding of the Indian Advocates Act, 1961 and the Rules framed thereunder by the Bar Council of India. The Rules of Supreme Court and High Court relevant to legal practice are also part of syllabus. Finally, the law of contempt of court in India is also to be studied in this regard.
