My company is working 5 days a week. As I have seen in various blogs for 5 days working 190 days is considered as whole year. I have completed 4years and 228 days. am I eligible for graduity? My company says you have to serve atleast 4years and 240 days to be eligible. I have sent them a link http://www.gratuity.org.in/gratuity-eligibility.php for reference but they say 190 days is applicable for mining industries only but for software industry 240 days is applicable. can anybody guide me on this?

CONGRATULATIONS...IN REF.TO YOUR PARA (G) "...Obviously the employer was having bad intention to not to make fair payment of Gratuity and IT's Attorney's also did not impress upon the employer to pay Gratuity fairly in accordance with provisions of Law/Enactments/Statue, and in the end employer and IT's attorney's got defeated in all forums, approached by them..." I am sure that the UOI,,GOI... AND THE FUNCTIONARIES RAILWAY BOARD AND OTHERS CONCERNED KNOW OF THE FACTUAL POSITION, BUT ALMOST WANTONLY MAKING THE HODs not to yield to GENUINE REPRESENTATIONS ON THE plea that THE C.G., OR THE RAILWAYS ARE NOT GOVERNED BY THE PG ACT AS THEY ARE Having their own SET OF RULES... which ITSELF shows that the RULES FOR PAYMENT OF GRATUITY ARE ULTRA VIRES AND AGAINST THE CONCEPT OF THE ACT, AND ALSO ....... .....AGAINST THE CONCEPT OF GOOD GOVERNANCE AND MASTER AND SERVANT RELATIONSHIP... ON THE ABOVE PARA...MY ARTICLE PUBLISHED IN LCI-LAWYERS CLUB INDIA WEB ON 14-12-2017... may kindly be considered to read... In my ARTICLE,I HAVE PLACED MANY MATERIAL EVIDENCE THAT OF HONOURABLE SUPREME COURT JUDGEMENT ORDERS AS JUDICIAL PRECEDENTS, RULES AND EXECUTIVE ORDERS, DIRECTIONS CAN'T OVER RIDE STATUTORY PROVISIONS LAID DOWN IN THE ACT... EVEN REGARDING ADHOC SERVICE CONTINUANCE, DEEMED PROMOTION. ETC... BUT STILL,. THE GOVERNMENT FUNCTIONARIES DOESN'T CARE ALL THESE APEX COURT ORDERS... AND WORK AS PER THEIR CHOICE SELECTIVES AND DETHROWING THE SAME TO DUSTBIN...
