Dear all, As Adv Sudhirghabasu says the Article 65 of the Limitation Act 1963 has been erroneously cited as Section 65 of the Act in this article. Sorry for the accidental error. Regards, K Rajasekharan

while I agree I still say in a globalization sequences today, that adverse possession under so called negligence is untenable; besides in the case of private properties 12 yrs limitation is wrong so in the case of government allowing 30 yrs of limitation itself obvious criminal negligence of very law makers, so the law makers obviously misused the power of law making so the right step my view is when an exiting government in proximity of property seek 30 yrs of precarious possession, not under adverse possession is something like a oligarchical power , in fact private owners need be given same precarious possession limitation may be reasonable if not, just declare that law invalid as constitution provides fundamental right that cannot be taken away or bridged by [parliament in terms of Article 368, so the old laws prior to 1950 which crisscross Constitution of India can be struck down by using Article 142 by the very supreme court of India, for it enjoys that power of judicial review is my take, if you read an article I recently posted, well indicates that indian political government uses all illegal ways to benefit illegal demands of very politicians that causes creation of new type of Oligarchy, if and when lawersclub published my article can provide detailed reasons for all wrongs politicians as law makers work for lobbyists and the like else where in every democracy. this evil prevails since AD.1315 if one reads in the History of laws.
