One has to know if you, as every lawyer has to ensure, that independence of Judiciary is vital for any democracy so every lawyer worth the name need to work for independence of judiciary, never bow before any kind of politics that is happening in India today , yea judiciary always faces tough political positions against equal justice - under 14th amendment in the USA - so Indian constitution founders tried to follow American Constitution principles as Alexander Hamilton , that is the real health of any Nation.

reason means without passion is obvious, if the political parties cannot understand the constitution of india fundamentals how such parties shall be allowed to function like the shiva sena, when u nook a ticket in fully economy class flgt how can you seek some business class like seat by ravindra gaikwad, i find sanjay raut says anybody gets angry behaves if so if shiva sena is full of some angry men better it dissolve is the right reasoning else civil disobedience movement and riots will ensue you one man how take on full air crew if thet thrash you what could happen to this great man's prestige as such; now gaikwad would file damages is it right reasoning who caused damage it ios he only naturally airindia as a carrier can file for exemplary liquidated damages on this man as also on the party, after all MP draws salary from exchequer so he is a servant of people no better .

sir, i would say as Aristotle correctly said law is reason when so why people like in shiva sena fail in reason, see the other day one shv sena MP takes law into his hands in thrashing a duty officer of Air India, how these parties are allowed to run political parties and how can they be law makers, is it not a reasonable question?

i am sure hon SC would give notice to Lok sabha secretary general, to spell out what kind of action the parliament would take on unruly MPs as such, if the parliament doesn't take naturally civil disobedience movement might surface like all public servants might go on indefinite strike, what reedy the Parliament would provide, notice would become returnable in 2 or 3 weeks, people are citizens dejure, representatives are in that role are called ;'defacto', and defacto persons, are like some 'legal person' but legal person may not harm but these representatives being persons in living might cause harm to fellow humans, citizens, when so , defacto persons - representatives - might have to be subject to same laws what normal citizens are subject to; so 36 hrs grace period for MPs before getting arrested if an FIR fi filed, should be removed forthwith by very Lok sabha speaker so too chairman rajyasaba so too in states by relevant legislatures is my considered opinion.

i am sure, these kinds of unapologitic persons for their behavior might get relevant punishments in any vibrant democracy besides these person will be exemplarily fined and allowed the victims get exemplary liquidated damages, here in the airline 's case the victim 's normal prestige is just shattered and his health might also deteriorate and who will compensate but for the very person rude behavior besides the very political party, if uddav thakeray o not mend the ways of shiva sainiks, sainiks are not special warriors like soldiers of a military force as india today don't have any 'rajas' or kings, just putting some turbans these sainiks can never become rajas, and they can never ever be comparable to 'shivaji maharaj' as such.

see sir today you have ravindra gaokwad some shiva sena MP, he had committed 'culpble homicide not amounting to murdmer, that means when the very party called shiva sena supports such behavior of its MPs or MLAs, or others in its party , it is obvious hon EC can under Art 14 issue notices to such cantankerous parties why these parties cannot be derecognized as political parties and why EC cannot bar these kind of persons if they change the parties too be permanently barred from elections with 3 weeks Notice , as nowhere in the constitution of India these kind of parties or these kind of persons should be treated on par of citizens, for exercising franchise too, thus why basic right of citizenship be withdrawn as is withdrawn for convicted serious criminals and the like positions can be brought about in order to chastise these 'uncouth' behavior, for citizenship is granted to sensible persons not lunatics too as under law of contracts lunatics cannot enter into any contracts at all; and that way we can eliminate these unbecoming characters from politics once and for all, it is obvious No court of law will ever allow these kind of parties or men to be in public life, for allowing such persons, democracy loses the very meaning od democracy.

Legal profession has nothing to lose or nothing to gain f the EC vier is accepted by the hon SC; after all legal profession is handling both on behalf f plaintiff 'complainant or respondent or defendant, that is the great position of the profession of law since it is only challenges statutes on the anvil of the constitution that is the guiding spirit of law.

Now very Apex ct might ask AG if he pleads on behalf of government not to bar the criminal politician for ever; it may not probably as PIL is by BJP man himself - if not, then the court would retort 'look doesn't country have clean political workers from among the so much of population? the AG may falter means hon ct would under Art 141 would declare ' Baring for life time' any criminal sentenced politician, obviously the basic two yr rule also gone with the wind.

see sirs, now EC rightly said Bar for life time any criminal politician, any way legal profession helped the criminals to go to jail and defense only defended against the criminal politicians - now EC rightly suggested to the Apex ct to bar for life time any Criminal politician even if he is MP or MLA, that way it is a right opportunity for clean political workers to seek to be a law maker. that way cleansing takes place in politics, none can dare to be a rapist or murderer being a politician if he were to attempt his story gets over for ever;...
