Dude, you are having some false notions about common plain writing. Trying to decipher between a legal draft and normal draft, you are super imposing your fallacies like "And and But" are not allowed in plain English - it seems you haven't read enough.

Mr. Ambrish has written excellent Article on legal drafting. Most of the countries English is not their Mother tongue but opted English language has its Legal Language most of the People do not have Craft of Legal Drafting for that we can not blame Drafter. Language learning has been one of the toughest for the People other than their mother tongue language even then the People are forced to learn English language as it has been International language and their country's official language. Interpretation of legal language courts always as a first step refer dictionary meaning, sentence formation words used its literal meaning. Unless Pupil is taught since child hood sound basic principles of English language basing on sound basic principles of Grammar they can not able to write Legal English Drafting or General English Drafting. For Law students legal Drafting with English language, Grammar basic Principles must be taught then they will be able to write Legal English drafting. Otherwise it will be called borrowed language rather than Persons own English language. India we have number of languages that made us to hunt for link language to communicate our thoughts, conversation, Administrative, Legal language as Britishers ruled India for more than two centuries they developed English as Administrative language, English as Legal language and English as General language, after independence India has been continuing English as Link language Administrative language, legal Language, General Language. Unless Indian Educational Institutions teach Pupil sound basic English Language basing on sound basic Grammar of English language Indians can not be able to write Legal English Drafting and General English Drafting.

Most important aspect of any agreement is to bring out clearly the intention of the parties. For this, simple English usage is most preferred course. Including clauses which are of remote consequences will create clutter of obligations and may also cloud and dominate the basic intention of the agreement.If any dispute were to arise, we should foresee how a Judge would interpret the agreement to adjudicate issues that may crop up before him

Mr. Tiwari, you are right. Legal language makes difference with common English language. But in my opinion, it should be in simple language, that any one can understand the contents of document.
