Dear Sir, My dad use to work in a company 4yrs ago. He completed 5yrs working there, after leaving he claimed for PF but wasn't aware about gratuity. Few months back a friend told him about gratuity, we filled up the required forms and submitted in the month of April. Now it's been four months after submitting the form, last week when I visited the office then H.R says its been long when your father left the company. He says it's not possible now. Sir please suggest something. Is my father liable to get the gratuity after 4 years of resignation. Regards Ronnie ronnie.f05@gmail.com

Dear Sir, I resigned from my OLD company on 10-Nov-2012, but still i havn't get my gratuity amount. Neither they are commiting any date. Kindly help me what to do.

Dear Sir, Here the wages you mentioned! kindly guide for the formulae is it the monthly salary or the per day wage as calculated on pro rata basic =total monthly salary/ 39 days

According to news in the Hindu,december 18,2009 The government would bring in the budget session of Parliament, a comprehensive bill on gratuity which would address issues like raising the gratuity ceiling from Rs. 3.5 lakh, in the light of the Sixth Pay Commission report that recommended raising it to Rs. 10 lakh. The proposed bill may take into account broadening the scope of gratuity benefits to cover contract labour, unorganised labour, seasonal labour and farm labour among others, the Minister of State for Labour Harish Rawat assured the Rajya Sabha members on Friday. “We are discussing this with the stakeholders,” he added.
