Registration Act : SEC : 17 :
Under the said section registration of a documents related to any immoveable property if it is more than Rs.100/- then it should be registered., even tittle of the immoveable property cannot be conveyed to other person without a properly stamped registered document. In case of evidence also not properly stamped and un registered documents cannot be admitted as an evidence.
In The ILR 1998 KAR 2650 it is reported that even merely by giving a vardi( statement in writing) property cannot be transferred. Usually property will be transferred to other person merely by giving a vardi. Such vardis will be given in case of relinquish of rights and mutual partitions.
High Court has come to the conclusion that : Sec 17: Tittle in respect of immovable property cannot be transferred by way of surrender by just giving a Vardi to the Town Panchyat.
