Maintenance sec 125 of Cr.P.C

SEC 125(1)(a) Maintenance-Expression ' unable to maintain herself' - Potential earning of wife is not in contemplation in expression- cannot be interpreted to mean capable of earning.

Hindu Adoptions and Maintenance Act ( 78 of 1956) S. 19 Maintenance Mere fact that wife is an MBA grduate will not disentitle her to claim maintenance. Wife who sacrifices her lucrative carrer, for the sake of her family, and if her husband neglects or refuse to maintain her on ground that she is highly educated and is capable of earning.  Not a sufficient ground to refuse maintenance-Eife entittled to maintenance.
