CONSUMER DISPUTES REDRESSAL MECHANISM COMES TO GRINDING HALT IN THE STATE OF TAMIL NADU

 

HIGH COURT ORDER DISOBEYED BY THE DEPARTMENT OF CONSUMER PROTECTION IN SETTING UP OF PERMANENT CIRCUIT BENCH  AT MADURAI

 

            The Consumer Protection Act – 1986 was enacted with considerable enthusiasm and fare as a path breaking benevolent legislation intended to protect the consumers from exploitation by more organized manufacturers/traders or service providers. The Government of Tamil Nadu had immediately established District Consumer Disputes Redressal Forum in all districts and was functioning effectively. Now, due to inept handling the Department of Consumer Protection has brought to halt the entire functioning of the Consumer Dispute Redressal mechanism (District Forums and State Commission) in the State. “ IS THIS THE NATIONAL CONSUMER DAY (24-12-2008) GIFT TO THE CONSUMERS ”.

 

DELAY IN THE SETTING UP OF PERMANENT CIRCUIT BENCH OF SCDRC, CHENNAI AT MADURAI INSPITE OF MADURAI BENCH OF HIGH COURT ORDERS - DEPARTMENT OF CONSUMER PROTECTION MAY SOON FACE CONTEMPT PROCEEDINGS FOR DISOBEYAL OF THE HIGH COURT ORDERS

 

                   Inspite of the directions from the Madurai Bench of Madras High Court and recommendation of the State Commission, and fulfilling all norms, the Department of Consumer Protection is dragging its feet and adopting delaying tactics hand in glove with vested interests in setting up of Permanent Circuit Bench at Madurai u/s 17-B of Consumer Protection Act – 1986. While many States have already formed Permanent Circuit Bench and all are functioning effectively and delivering justice to the consumers.        

 

FUNCTIONING OF DISTRICT CONSUMER FORUMS IN TAMIL NADU BROUGHT TO GRINDING HALT

 

             In 19 districts the District Consumer Disputes Redressal Fora is defunct as the post of President are kept vacant.  The term for the Presidents for the remaining district comes to end in January 2009. Which literally means the functioning of Consumer Courts (DCDRF’s) comes to a grinding halt and the very purpose of enactment of the Consumer Protection Act – 1986 is nullified by the Department of Consumer Protection.

 

STATE COMMISSION TOO  BECOMES DEFUNCT : APPOINTMENT MADE BY DEPARTMENT OF CONSUMER PROTECTION NULLIFIED

 

             The appointment of President of SCDRC, Chennai by the Department of Consumer Protection was challenged through a Writ of Quo-Warranto before the Hon’ble High Court of Madras and the same was allowed. Thus not only the District Consumer Disputes Redressal Forum, the State Commission too goes headless.
